The petitioner/Punjab State Power Corporation

Ltd./judgment debtors are aggrieved of the impugned order dated 06.05.2013, vide which, objections filed by the petitioner in execution petition, have been dismissed. The dispute pertains to the execution of the judgment and decree, whereby, respondent is entitled to the arrears of salary. Both the parties have not placed on record the exact amount enabling the Executing Court to arrive at a conclusion and to pass an appropriate order.

I am of the view that both the parties are levelling allegations/cross allegations vis-a-vis payment, thus, deem it appropriate to direct the parties to give calculations commensurate with the judgment and decree which would enable the trial Court to

arrive at equitable decision for execution of the judgment and decree.

Keeping in view the aforementioned observations, the impugned order is set aside. The matter is remitted back to the trial Court directing the parties to submit their calculations. On submission of the calculations, the trial Court shall decide the controversy as per the judgment and decree. The impugned order is set aside.

Accordingly, the revision petition is allowed.

Executing Court shall make endeavour to decide the
