Through the instant petition, the petitioner is seeking anticipatory bail in complaint No. 04 of 19.05.2014, titled as 'Seeha Singh Vs. Bheem Singh', under Section 3 of SC & ST (Prevention of Atrocities) Act, 1989, pending before Sub Divisional Judicial Magistrate, Moonak.
Learned counsel for the petitioner states that in pursuant to the order dated 26.05.2015, passed by the co-ordinate Bench, the petitioner had put in appearance before the trial Court and had been admitted to interim bail. He further states that charge has been framed and the case is fixed for evidence of the complainant.
Looking to all these circumstances, but without commenting on the merits of the case, the petition is allowed and order dated 26.05.2015 granting interim bail to the petitioner is made absolute subject to the conditions laid down in Section 438 Sub Section 2 Clauses (i)(ii) and (iii) of the Code of Criminal Procedure.
