Defendant is in revision aggrieved by the order dated 7.1.2015 (P-1) passed by Civil Judge (Senior Division) Ferozepur
whereby application of the plaintiff for leading additional evidence has been allowed.
It is apparent that the plaintiff filed a suit for recovery of Rs.8,59,400/- under Order 37 CPC on the basis of pronote and receipt with the averment that the defendant has signed in English.
Defendant took up the plea that he does not sign in English and rather being a illiterate affixes his thumb impression on the documents and therefore denied the pronote and receipt. Plaintiff has been permitted to place on record the subsequent sale deed allegedly executed by the defendant/petitioner by affixing his signatures in English.
