On the joint request made by learned counsel for the parties, the case is taken up on board for final disposal.

It is a joint application on behalf of the parties under Order XXIII Rule 3 read with Section 151 C.P.C., for final disposal of the appeal in terms of the compromise deed dated 14.12.2013 (Annexure -1), arrived at between the parties.

Learned counsel for the parties are ad-idem that the parties have amicably settled the dispute. A compromise deed dated 14.12.2013 (Annexure 1) has been reduced to writing between the parties. agreed to the terms and conditions of the settlement. In this view of the matter, learned counsel for the parties jointly pray that the appeal may be disposed of in terms of the compromise arrived at between the parties.

In view of the above common stand taken by learned counsel for the parties, the instant appeal is disposed of in terms of the compromise deed dated 14.12.2013 (Annexure 1) arrived at between the parties. The compromise deed dated 14.12.2013 (Annexure 1) arrived at between the parties, shall form part of the decree and the parties will be bound by the terms and conditions thereof.
