respondent/defendant did not come forward to execute the sale deed. Even on 25.8.2005, the appellant/plaintiff along with the residue amount and other expenses remained present in the office of the Sub-Registrar, Mullana, and waited till 2:00 p.m., but the respondent/defendant did not turn up and, thus, failed to execute the sale deed of the land in dispute in favour of the appellant/plaintiff. He even visited the house of the respondent/defendant, but she (defendant) was found to be out of station. Despite approaching the respondent/defendant several times, she failed to execute the sale deed of the land in dispute in favour of the appellant/plaintiff. Later, the appellant/plaintiff came to know that the respondent/defendant had already sold the land in dispute vide Sale Deed No. 563, dated 6.7.2006, in favour of some other person, in contravention of the agreement to sell dated 26.4.2005. A legal notice dated 30.3.2007 was sent to the respondent/defendant, requesting her to execute the sale deed of the land in dispute on receipt of the remaining sale consideration, but still the respondent/defendant failed to perform the obligation of her part. Seeing no other alternative, the appellant/plaintiff filed the suit for recovery of an amount of `2,00,000/- along with interest and penalty.
