Learned counsel for the parties are ad1idem that the instant appeal is squarely covered by a judgment dated 13.02.2014 of this Court passed in RSA No.2364 of 2013 and RSA No.2357 of 2013, wherein similar substantial questions of law on similar facts were raised and the said appeals were dismissed holding that no substantial question of law arises for consideration.
In view of the aforesaid, this appeal is dismissed holding that the substantial questions of law, as raised in the grounds of

appeal, do not arise therein for the reasons recorded in the judgment dated 13.02.2014 of this Court passed in RSA No.2364 of 2013 and RSA No.2357 of 2013.
At this stage, learned counsel for the appellants has submitted that SLP No.9511 of 2014 filed against the aforesaid judgment dated 13.02.2014 of this Court, is pending before Hon’ble the Supreme Court. However, it could not be disputed that operation of the impugned judgment dated 13.02.2014 passed in RSA No.2364 of 2013 and RSA No.2357 of 2013 has not been stayed. Thus, the pendency of SLP will not affect the ratio of law as settled by the aforesaid judgment.
Dismissed.
