According to the further averments, defendants No.1 to 4 attempted to grab the property of Hardayal Kaur and the appellant, and taking undue advantage of his absence from India and old age of Hardayal Kaur, defendants No.2 to 5 started alleging themselves to be the Legal Representatives of the plaintiff6appellant. They also filed Civil Suit for declaration seeking his civil death. It is further averred that defendants No.2 to 5 fabricated the sale deed on 30.03.2000 showing the same to have been executed by Hardayal Kaur (since deceased), as power of attorney of the appellant and produced the same before the Sub6Registrar, Kaithal for registration but Hardayal Kaur died during this period and as such Sub6Registrar, Kaithal vide his order dated 19.6.2000 did not register the same. Defendants No.2 to 5 filed appeal before the Court of Registrar, Kaithal against the order dated 19.06.2000 passed by the Sub6Registrar, Kaithal. The Registrar, Kaithal passed an order dated 21.07.2000 directing the Sub6Registrar, Kaithal to register the sale deed. The said order of the Registrar dated 21.07.2000 has been challenged by the plaintiff6 appellant by filing the instant suit further seeking declaration to the effect that sale deed dated 30.03.2000 registered on 25.07.2000 was illegal and also seeking injunction against the respondents.
