By way of this common judgment, 12 regular second appeals bearing Nos.43, 44 of 2000, 3700, 2757, 2752, 2367 of 1999, 3419, 3420, 3702, 3707, 3708 of 2001 shall be disposed of as the subject matter involved in all the appeal is same.

Reference Court vide order dated 25.08.2000, awarded enhanced compensation to the claimants at the rate of ` 1000/- per marla and further ordered they would be entitled to 12% per annum increase on the market value for the period commencing on and from the date of the notification under Section 4 of the Land Acquisition Act (for short 'the Act').

During the course of arguments, it has been brought to the notice of this Court that the same very notification vide which the land in question acquired had been subject matter of adjudication by this Court in RFA No.4525 of 2001 titled as Thuru Ram vs. State of Punjab and others decided on 16.03.2009 and other connected appeals.

In view of the above discussion, the present regular first appeals, in terms of order dated 16.03.2009 passed in RFA No.4525 of 2001, are allowed and the impugned order of the Reference Court is set aside. The claimants would be entitled to all the statutory benefits as per the amended provisions of law.
