Learned counsel for respondent No.2, assisted by Mr. Jatinder Chadha, Assistant Manager, has explained, with reference to the statement of account, that the balance of ` 1,250/ - is towards the principal amount and the last column in the statement of account is showing the balance inclusive of interest. It is, of course, admitted that if principal amounts due in both the accounts are taken as on the date of sale, then there would be excess funds available beyond what is outstanding, but the amounts have been accumulated on account of the interest component.

Learned counsel for respondent No.2, on instructions, also states that the OTS Policy notified by the Government of Punjab on 2.3.2009 continued to be in force intermittently till 20.1.2014. However,

this fact was unknown to the petitioner and apart from that lis was pending in this Court.

In our view, thus, it is a fit case where under the said Policy the case of the petitioner should be examined and the balance, if any, quantified which the petitioner will pay within the stipulated time as required under the policy.

The aforesaid is acceptable to learned senior counsel for the petitioner on instructions from counsel on record.

The respondent No.2 to communicate to the petitioner, within 15 days from the date of application by the petitioner, the amount due which is stated to be in the range of ` 4 lacs plus. Learned counsel for the petitioner states that the application will be filed within two weeks.

The petition accordingly stands disposed of with liberty to move for clarification, if so required.
