(1) The petitioner’s claim for allotment of a plot under the oustees policy has not been accepted by the Estate Officer, HUDA, Gurgaon vide impugned order dated 28.02.2013 (Annexure P9) on the ground that in view of the directions issued by this Court, the plots to the oustees can be allotted only by way of public advertisement and not on the basis of any application submitted by the oustee.

(2) In our considered view, the Estate Officer is fully justified in saying that the allotment will have to be made in a transparent manner and by considering the claim of all the oustees. However, it is imperative upon the respondent-Authority to take necessary steps including issuing the advertisement within a reasonable time.

(3) In a bunch of cases, this Court had been assured by the State Government as well as the Chief Administrator, HUDA that all

the eligible oustees shall be allotted plots expeditiously. We thus dispose of this writ petition with a direction to the respondents to issue an advertisement in this regard at the earliest; consider the claim of all the oustees subject to their eligibility including the petitioner and make allotments preferably within a period of six months from the date of receipt of a certified copy of this order.
