After arguing for some time, counsel for the petitioner does not press the present writ petition since challenge is to the garnishee order passed under Section 45-G of the Employees' State Insurance Act, 1948 (in short 'the Act'). It is conceded that the initial order dated 28.05.2013 (Annexure P-1) whereby, the amount of `2,28,800/- was assessed, has not been appealed against. In such circumstances, counsel prays for liberty to withdraw the writ petition and to take recourse to his alternative remedy of appeal under the provisions of the Act.
Ordered accordingly.
