In the impugned order dated 25.04.2014, it has been stated by the Executive Engineer, Bathinda Canal Divn. Bathinda that the Peori Distributory/Minor is part of the system of irrigation being fed by Sirhind Canal, which is in operation since the year 1882. The land of the petitioner is also being irrigated by the canal water being supplied through this system. The land for which compensation is being demanded by the petitioner falls in village Peori, Tehsil Gidderbaha, District Sri Muktsar Sahib. The land of the petitioner abuts RD 15200-15550 of Peori Distributory. As per record, the Chakbandi of Outlet(Mogha) RD 9037/R of village Peori was corrected by the Divisional Canal Officer, Bathinda, vide order dated 18.10.1965. Copy of L-section of New Peori Distributory shows that L-section has been approved by the office of Chief Engineer on 07.03.1961. These records demonstrate that the irrigation system of village Peori was in existence more than 50 years and is thus in possession of the department. The brick-lining work of this Distributory was completed in the year 1979-80. The Superintending Engineer, Canal Lining Circle, Bathinda had intimated that the brick-lining work of the Distributory was done within the available land and no new land was acquired for this purpose.
