Petitioner seeks the concession of regular bail in a case registered at the instance of Santosh Kumari and Balbir Kaur alleging that the property owned by Daulat Ram was inherited by Chanan Kaur, Lehmber Ram and others but two of the co-sharers Ram Murti and Joga Ram have sold the property on the basis of power of attorney dated July 9, 2003 in favour of Parminder Singh, Gurdev Singh and Balwinder Singh.

Allegations of the prosecution is that Surti Ram had allegedly died on July 9, 2011 but despite that petitioner alongwith Ram Murti on September 19, 2011 executed the sale deed of 14 kanals of land in favour of abovesaid vendees. Co-accused of the petitioner, namely, Ram Murti, similarly circumstanced, has been granted the concession of regular bail by a Coordinate Bench of this Court on January 14, 2014.
Without expression of any opinion on merits of the case, petitioner can be granted the concession of bail during the pendency of the trial as he has undergone custody of about 10 months.
Petition is allowed. Petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial Court.
