Prayer in this petition is for grant of regular bail to the

petitioner, Mahender, who has been booked for having committed the offences punishable under Sections 147, 148, 307, 323, 427 and 448 read with Section 149, IPC, and Sections 25 and 27 of the Arms Act, in a case arising out of FIR No.1090, dated 01.12.2011, registered at Police Station, City, Hisar.

Learned Senior counsel contends that initially the petitioner was arrested in the present case on 30.12.2011 and granted bail by this Court vide order dated 07.09.2012; on account of personal difficulty, the petitioner absented himself from learned trial court on 25.07.2013 and thereafter, taken into custody on 12.08.2013 and as such, he remained absent for

approximately 18 days only; and for his absence from learned trial court, he is behind the bars for the last one year and approximately four months.

Learned counsel for the State has not controverted the submissions made by the learned Senior counsel for the petitioner.

After hearing the learned counsel for the parties and going through the material available on record, the present petition is allowed. Petitioner-Mahender, son of Hari Singh, r/o VPO Talwandi Rana, Tehsil and District Hisar, is ordered to be released on bail during pendency of the trial of the present case subject to his furnishing bail bonds in the sum of Rs.1,00,000/with one surety in the like amount to the satisfaction of the learned Chief Judicial Magistrate/Duty Magistrate, Hisar.
