Petitioner has filed this petition under Section 438 of the Code of Criminal Procedure, 1973 seeking anticipatory bail in FIR No. 86 dated 24.6.2008 under Section 420, 463, 467, 468, 471, 120-B of the Indian Penal Code, 1860, registered at Police Station City Ropar, District Ropar.

“Learned senior counsel appearing for the petitioner submits that the only role attributed to the petitioner is that he allegedly gave assurance to the complainant that the land in question had a clear title. He is neither shown to be the receiver of the

transaction, except, obviously, to the extent of his fee as counsel.

Learned State counsel has submitted that though the Investigating Agency had found the petitioner innocent and placed him in column No. 2, he has, now, been summoned by the trial Court on an application moved under Section 313, Code of Criminal Procedure, vide order (Annexure P-3).

A perusal of the said order shows that the summons were issued to the petitioner on account of what is stated to be specific allegations against him.

Since the State, in any case, had found the petitioner innocent, notice be issued to the complainant i.e. Puran Singh son of Kharat Singh, resident of village Hussainpur Kandhi, District Fatehgarh Sahib, returnable on 15.7.2014.

In the meanwhile, the petitioner would be admitted to ad-interim bail by the learned trial Court, to the satisfaction of that Court.

The revenue record for the land in question, as it existed on the dates when the two agreements to sell the land were made, be also produced.”

submitted that in terms of the above order, petitioner has surrendered before the Trial Court and has furnished interim bail.
