Petitioner has been in custody w.e.f. 24.3.2013. After hearing the counsel for the petitioner, it appears that case of the prosecution rests upon circumstantial evidence. The material witnesses in support of the circumstances pointing towards the involvement of the petitioner have either not supported the case of the prosecution or have been given up by the prosecution agency. Out of 17 witnesses, 11 witnesses seem to have been examined.
Without commenting upon the merits of the case, this petition is disposed of with a direction to the trial Court to conclude the trial within a period of two months after the next date of hearing. The trial Court shall follow the provisions of Section 309 Cr.P.C.
