Instant petition has been filed under Section 439 (2) Cr.P.C. for cancellation of regular bail granted to respondent no. 2 vide order dated 17.01.2014 passed in CRM-M-18233 of 2013 (Annexure P-2) in FIR No. 177 dated 22.05.2012 for offences under Sections 147, 148, 149, 323, 324, 307, 302 and 120-B of Indian Penal Code (IPC) and Section 25 of Arms Act, 1959, registered at Police Station Hodal, District Palwal.
On 26.04.2014, Superintendent of Police, Palwal was directed to entrust the matter to a police officer not less than the rank of Deputy Superintendent of police. Now response by way of affidavit of Jai Parkash, Deputy Superintendent of Police, who is also present in person, has been filed.

present submits that as per enquiry, the allegations have been found incorrect. It is further submitted that most of the witnesses have already been examined by the prosecution.
In view of the above, the instant petition is disposed of but it is directed that in case any representation about the threat to the life and liberty of the petitioner is filed, Senior Superintendent of Police, Palwal would look into the same.
