Petitioner-Sukhdev Singh son of Gurdev Singh, has preferred the instant petition for the grant of concession of regular bail, invoking the provisions of Section 439 Cr.P.C., in a case registered against him along with his other co-accused namely Gurnam Singh and others, vide FIR No.97 dated 03.05.2013, on accusation of having committed an offence punishable

under Section 489-B IPC, by the police of Police Station Sadar, Sirsa.

Notice of the petition was issued to the State.

After hearing the learned counsel for the parties, going through

the record with their valuable assistance and after deep consideration over

the entire matter, to my mind, the present petition for regular bail deserves to be accepted in this context.

It is not a matter of dispute that main accused Gurnam Singh has already been granted the concession of regular bail in this case by a Coordinate Bench of this Court (R.P. Nagrath J.) by virtue of order dated 29.01.2014 rendered in CRM-M No. 792 of 2014, which in substance, is as

“ The petitioner seeks bail under Section 439 Cr.P.C. in FIR No. 97 dated 03.05.2013 for offence under Section 489-B of Indian Penal Code (IPC), registered at Police Station Sadar Sirsa, District Sirsa.

Learned State counsel on instructions from ASI Kamlesh submits that the petitioner was found in possession 88 counterfeit currency notes of denomination of _500/- each, amounting to_ 44,000/- . The petitioner is in custody since 04.05.2013. It is further submitted that the challan has already been presented. It will take sometime in conclusion of the trial.

In view of the above facts and without commenting on merits of the case, the instant petition is allowed and petitioner be admitted to bail on furnishing bail bonds to the satisfaction of trial Court.”

Therefore, once the main accused Gurnam Singh has already

been granted the concession of regular bail by this Court, in that eventuality, I see no reason not to extend the concession of regular bail to the present petitioner under the same set of circumstances. Moreover, the petitioner was arrested on 20.05.2013. Since then, he is in judicial custody and no useful purpose would be served to further detain him in jail. There is no history of his previous involvement in any other criminal case. Even since the prosecution has not yet examined a single witness, so, conclusion of trial will naturally take a long time.

In the light of aforesaid reasons, taking into consideration the totality of facts and circumstances, emanating from the record, as discussed here-in-above and without commenting further anything on merits, lest it may prejudice the case of either side, during the course of trial of main case, the instant petition for regular bail is accepted. The petitioner is ordered to be released on bail on his filing a specific affidavit to the effect that he will not indulge in such illegal activities in future and furnishing adequate bail and surety bonds to the satisfaction of the trial Court.
