Petitioner seeks the concession of regular bail. As per the case of prosecution, petitioner alongwith one another person was seen unloading bags from a car. On approach of the police, the other person drove the car and fled away from the spot. While the petitioner made an attempt to run, he was apprehended alongwith 3 bags containing 102 kg of poppy husk. The petitioner has been in custody w.e.f. April 15, 2013. The co-accused of

the petitioner has been nominated as Nirmal Singh on the statement of the petitioner made before the police but he has not yet been arrested.

On asking of the Court, it has been informed regarding status of the trial that one witness out of seven prosecution witnesses has been examined.

Taking into consideration the period of detention suffered by the petitioner i.e. for a period of one year and only one witness having been examined, without expression of any opinion on merits of the case, I deem it appropriate to dispose of this petition with a direction that the prosecution agency will produce all the witnesses for examination by the Court within a period of six months from next date of hearing which is stated to be April 26, 2014. It is ordered that in case the trial is not concluded within a period of six months w.e.f. April 26, 2014 i.e. by October 25, 2014, the trial Court shall release the petitioner on bail on his furnishing bail bonds/ surety bonds to its satisfaction.
