Although, Inspector Des Raj has deposed qua recovery of tainted currency notes from the appellant at the time of raid but his statement remains uncorroborated. Therefore, prosecution case is rendered doubtful. Firstly, the complainant as well as shadow witness have not supported the prosecution case qua demand or acceptance of bribe by the appellant. Further, in the present case, the tainted currency notes were recovered from the register. As per PW-6 Mange Ram Verma, the complainant had stated that she had kept the tainted currency notes in the register. This fact makes the prosecution case doubtful as the complainant might have kept the currency notes in the register without the consent of the appellant. Further, the currency notes produced in the Court, did not bear the signatures of PW-6 Mange Ram Verma whereas it is the case of the prosecution that the currency notes in question were duly initialled by PW-6 Mange Ram Verma as well as PW-12 Inspector Des Raj. All these facts make prosecution case doubtful.
