Learned counsel for the petitioner, at the very outset, fairly states that since the controversy involved herein has been settled by a later Division Bench judgement of this court in S urjit Singh and others Vs. Jagtar Singh
and others, AIR 2007, Punjab and Haryana page 1, petitioner would be satisfied in case the learned trial court is directed, to take into consideration the law laid down by the Division Bench judgement in Surjit Singh's case (supra), at the time of final decision of the case.
Nobody has appeared on behalf of the respondents.
In view of the above statement made by learned counsel for the petitioner, the instant Civil Revision is disposed of, with a direction to the learned trial court to ensure meticulous compliance of the law laid down by the Division Bench judgement of this court in Surjit Singh's case (supra) and shall read only that part of evidence, which shall be in consonance with the law laid down by the Division Bench in Surjit Singh's case (supra), at the time of
