Facts in brief are that plaintiff-M/s Ganga Cotton and Oil Mill (hereinafter referred to as the plaintiff- consignor) transported a consignment of mustard oil to Calcutta through a Carrier-M/s Khera Oil Tanker Service (defendant no.3). The said consignment of mustard oil was insured with the appellant-Insurance Company (defendant no.1). During transportation the tanker met with an accident resulting into loss of goods, consequently the suit by the insured consignor for recovery of Rs.7,03,440/- alongwith interest was filed. The appellant/Insurance Company filed a written statement inter alia taking up the plea of total denial of the accident. The learned trial court on the basis of the evaluation of the evidence adduced on record decreed the suit, by holding the liability as joint and several, for the claimed amount alongwith interest @ 12% per annum from the date of accident i.e. 22.7.2003 till filing of the suit and simple interest @ 6% till actual realisation.
