Facts in brief are that plaintiff nos. 1 and 2 are sons of Megh Singh, defendant no.1 and plaintiff no.3 is wife of defendant no.1 Megh Singh. Defendant no.2-Arjan Singh is brother of Megh Singh. Defendant no.3-Balwant Singh purchased the suit land vide sale deed dated 10.4.2003 from defendants 1 and 2, whereas defendant no.4-Harbans Singh and his brother defendant no.5-Harbhajan Singh purchased the said suit land from defendant no.3 vide sale deed dated 14.11.2005 during the pendency of the suit. Plaintiffs sought a declaration claiming to be owners in possession of 1/18th share each of the agriculture land measuring 62K1M fully described in the plaint, situated in Village Harike, District Sangrur. Further prayer was for declaring the sale deed dated 10.4.2003 executed by defendants 1 and 2 in favour of defendant no.3 as null and void on the ground that the suit land was ancestral and coparcenary property of Joint Hindu family. Since during the pendency of the suit defendant no.3 vide registered sale deed dated 14.11.2005 had sold the suit land to defendants 4 and 5 the same was also challenged.
