There is no ground other than administrative delays for 140
days extra time taken to file the appeal.
We are of the view that no ground is, thus, made out for condoning the period of delay and the delay and laches are unexplained.
Dismissed.
LPA- 2138- 2013 & CM- 5424- 2013 (For stay) :
As a sequitor to the aforesaid order, the appeal and the
application for interim relief are also dismissed.
We may clarify at the request of learned senior counsel for the appellant that in view of the admissions having already been carried out, the issue now, in any case, is academic and as and when the situation arises, the appellants will urge the necessary pleas in that particular matter.
