CM No.7045-CII of 2013 has been filed for permission to withdraw the appeal.
The appellant Divya filed a petition under Section 12 of the Hindu Marriage Act, 1955 seeking nullity of the marriage between the parties. The respondent was proceeded ex parte. However, the petition was dismissed vide judgment and decree dated 15.02.2013 passed by the learned Additional District Judge, Rohtak. The appellant filed present appeal (FAO No.M-64 of 2013) in this Court. Notice of motion was issued on 04.03.2013 for today. As per office report, notice issued to the respondent for today has not been received back served or otherwise. No one also put in appearance for the respondent. However, the appellant prays for withdrawing the appeal.
Accordingly, the appeal is dismissed as withdrawn.
