The present petition has been filed for issuance of direction to respondents No.1 and 2 to quash the admission of respondent no.4 to D.M. (Pulmonary Medicine) course in the respondent No.1-institute starting from 1.7.1993 and to select the petitioner for the said course.

While issuing notice of motion, the Division Bench directed the respondents to permit the petitioner to join the course of D.M. starting from Ist of July, 1993 on provisional basis and the said admission was subject to the final decision of the writ petition. Thereafter, the writ petition was admitted on 24.11.1993.

Counsel for respondents No.1 and 2 states that the petitioner in pursuance of the interim order dated 18.6.2013 passed the said course on 30.6.1995.

Counsel for the petitioner, however, states that he has no instructions regarding the said fact.

Accordingly, keeping in view the facts and circumstances of the present case and in view of the fact that no prejudice is caused to any one and the petitioner has also successfully completed the D.M.(Pulmonary Medicine) course, it would be appropriate if the said provisional admission granted to the petitioner is regularised since respondent no.4 has also completed the said course way back in the year 1995.

Accordingly, the writ petition is disposed of as having been rendered infructuous, however, with the stipulation that the provisional admission granted to the petitioner is regularised and the degree obtained by the petitioner thereof shall be valid for all practical purposes.
