Civil Writ Petition No.5644 of 1993 (O&M) - 2 -
regards the third case, namely, CWP No.1276 of 1993, the case was adjourned to await the decision in CWP No.8206 of 1992. The Registry has noted that CWP No.8206 of 1992 itself has been decided in terms of the decision in CWP No.11023 of 1991. Consequently, all the three cases would follow the manner of disposal in CWP No.11023 of 1991.

put in 18 years of service and who had been given exemption from passing the Assistant Grade Examination on 21.01.1991 and who had passed the AGE and promoted as Senior Assistants, should not be reverted.
“It is further clarified that the promotion to the posts of Assistant (now Senior Assistant) lying vacant prior to 21.1.1991 shall be made from the eligible candidates on the basis of then existing rules by ignoring the exemption from qualifying the test granted w.e.f. 21.1.1991 to those persons who had put in 18 years of service while for promotion to the posts remaining vacant due to non-availability of eligible persons or falling vacant on 21.1.1991 and onwards, such persons who had been exempted from qualifying the test had to be treated at par with those persons who had already qualified such test and their promotion has to be made on the basis of their original seniority-cum-merit basis as Clerks/Senior Clerks/ Junior Assistant.”
