The petitioner prays for issuance of writ of mandamus to direct respondent No. 3 not to change the nature of the land, in dispute, as it is reserved, as per consolidation proceedings, as a ground for “Mela Falgun Tirath”.
Counsel for the Gram Panchayat submits on the basis of averments in the reply that the Gram Panchayat has neither changed nor does it intend to change user of the land, in dispute It is further submitted that the land is leased out for cultivation during the period between two “Melas” (fairs) with a specific rider that at the time of “Mela Falgun Tirath”

the land would be used for purpose of the Mela.
In view of statement made by counsel for the Gram Panchayat as well as averments in the reply, filed on its behalf, the petition has been rendered infructuous and is disposed of accordingly.
