Admittedly the petitioners' appeal against an order dated 30.08.2010 is pending before the Appellate Authority. During pendency of that appeal, a letter was written by BDPO, Sirhind to the Tehsildar, Fatehgarh Sahib to change mutation of the land in dispute in the name of the Gram Panchayat, in response of the order mentioned above. The petitioners have come before this Court by filing the present writ petition with a prayer to quash letter dated 20.06.2012(Annexure P-14).

Today in Court, it has been brought to our notice that

arguments in the appeal were heard on 02.05.2012. However, due to transfer of the Officer concerned, order could not be pronounced. Under the circumstances, we direct the Director, Rural Development and Panchayat Department, Punjab to fix that appeal for re-hearing on 25.07.2013 and hear the arguments. The parties shall appear before the Officer mentioned above on the date fixed. Officer concerned, after hearing the arguments on that very date or within four weeks thereafter, decide appeal filed by the petitioners as per law. Till such time, order is not passed in that appeal, the Tehsildar is directed not to act upon letter (Annexure P-14).

The present writ petition is disposed of with the abovesaid directions

Copy of the order be given to the counsel for the parties under the signatures of the Court Secretary of this Court.
