Jagraj Singh Vs State of Punjab and Ors.

By filing this writ petition the petitioner prays that order passed by the Deputy Commissioner, Ferozepur on 9.4.2013 suspending resolution passed by the Gram Panchayat dated 10.11.2007 be quashed.

Vide that resolution 16 kanal 4 marla of land was given on lease to the petitioner for a period of 14 years. The Deputy Commissioner has suspended the resolution by exercising the powers under Section 199(3) of the Punjab Panchayati Raj Act, 1994 and he has referred the matter to the Director Panchayats, Punjab for necessary action. It is grievance of the petitioner that before passing that order no opportunity of hearing has been granted to him.

Be that as it may, Section 199(3) gives powers to the Deputy Commissioner to suspend a resolution in case of an emergency, if the said resolution is detrimental to the public interest, the same can be cancelled

only by the Director Panchayats, Punjab.

As the matter has been referred to the above said officer, this writ petition is disposed of giving liberty to the petitioner to approach Director Panchayats, Punjab for necessary relief. Above officer is directed to give an opportunity of hearing to the petitioner before cancelling the resolution, in question, passed by the Gram Panchayat.
