This petition has been filed with a prayer that illegal mining being done in the area of village Parjean Biharipur, Sidwan Bet Jagraon, Ludhiana be stopped.

Photographs have been placed on record to show that digging to extract minor minerals is going on at the spot. It is grievance of the petitioner that mining is being done without any permit and further the persons who are digging the land at the spot, had also entered the land owned by the petitioner and are using it for parking trucks and machinery.

Taking note of facts and above circumstances, we dispose of this writ petition by directing respondent no. 5-General Manager-cum-Mining Officer, Department of Mining, Phase I, SAS Nagar, Mohali to conduct a survey at the spot under direct supervision of the Deputy Commissioner, Ludhiana to verify whether digging at the spot, as indicated by the petitioner, is being done under a lease/permit. done as per norms set down by the State Government. It will also be affirmed as to whether the land of the petitioner is being used by the persons mining. If the digging at the spot is unauthorized and against the rules, it be stopped immediately and if anybody is entering in the land of the petitioner, he be also stopped. If need be, the said officer can seek police assistance from the concerned Senior Superintendent of Police.
