The grievance of the petitioner is set out in the representation dated 30.4.2013 (Annexure P-4), which is addressed to the District Registrar, Firms and Societies, Kaithal.

The petitioner is an old member of the Jat High School Society, Karnal Road, Kaithal. The State of Haryana has promulgated the Haryana Registration and Regulation of the Societies Act, 2012, which mandates that all Societies registered in Haryana would have to seek fresh registration numbers under the new Act. The request made on 30.4.2013, according to the petitioner, has not been addressed or decided while the President and Secretary of the Society are in the process of passing a special resolution to elect members of the Collegium through a meeting of the governing body

and if this is permitted to be done before the registration of the Society, miscarriage of justice may follow since then the election process can be initiated and concluded even before the District Registrar applies his mind to the registration of the Society. In these circumstances, there appears some merit in what the petitioner says that it is a statutory obligation and duty of the District Registrar to give effect to the new Act and to call upon parties requesting to complete formalities before grant of new registration number to the Society, therefore, the petitioner would be satisfied, if a direction is issued to the District Registrar to consider and decide the representation dated 30.04.3013 (Annexure P-4) and carry out his statutory duty without delay so that no member(s) of the society play/s truant with the law.

Ordered accordingly.
