The revision petition has been filed seeking modification of the sentence of respondents nos. 2 to 5 imposed by the learned trial Court to that of death sentence and for payment of compensation of Rs.50,00, 000/-.
Learned counsel submits that in terms of the proviso of Section 372 Cr.P.C, an appeal against inadequate sentence would not be maintainable by a 'victim' . Besides, for the purposes of compensation, he be permitted to file an application in the pending criminal appeal No. D-161-DB of 2013, filed by the convicts.
Accordingly, the criminal revision petition is dismissed as withdrawn. The petitioners may avail their remedy in accordance with law insofar as their claim for compensation is concerned.
