Balwinder Singh @ Kala, the petitioner seeks regular bail in a case registered by way of FIR No. 179 dated 16.08.2012 at Police Station Jandiala Guru, Amritsar Rural, District Amritsar, for an offence punishable under sections 419, 420, 465, 467, 468, 471 and 472 IPC.

Learned counsel for the petitioner submits that the petitioner has been apprehended for keeping in his possession fake seals etc. for preparing forged documents. According to him, he has a dispute with his sister and his sister has got all this planted on him to get him involved in this case. He drew attention of the court to enquiry report of DSP where it is mentioned that no complaint of any kind against the petitioner had been received in the police station of forging the documents. He further submits that the petitioner is in custody

now for the last more than eight months and the trial court of the case would proceed with Magistrate of the Ist Class and would take long time to be over.

Learned State counsel, on the other hand, submits that number of forged passports, ration cards etc. have been recovered from the possession of the petitioner. According to her, he is in habit of having all these prepared. She further submits that he has opened accounts with bank with forged identities on the basis of forged identity cards prepared by him.

It is a fact that trial of the case is proceeding with Magistrate of the Ist Class and it would take long time to be over. The other fact is that the petitioner is in custody for the last more than eight months. Looking to the enquiry report of the DSP, it is to be said that the trial court would have to find out after taking evidence if he has used any forged documents or that the aforesaid material has been planted upon him. Keeping in view the period of custody he has undergone in this case and the fact that the trial would take long time to be over,I find the petitioner to be entitled to bail during the trial. Therefore, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing a personal bond in a sum of Rs.30,000/- with one surety in the like amount to the satisfaction of learned trial court.
