The present petition filed under Section 439 Cr.P.C. is for grant of bail to the petitioner in case FIR No.170, dated 6.11.2012, under Sections 306, 34 IPC, registered at Police Station Lalru, District SAS Nagar.
I have heard learned counsel for the petitioner and have gone through the whole record carefully, including the impugned order passed by learned Sessions Judge, SAS Nagar Mohali, vide which application filed on behalf of the present petitioner for bail was dismissed.
Brief allegations are that marriage of petitioner was performed with deceased in the year 2000. Two children were born out of the wedlock. However, after few years of the marriage, petitioner alongwith other family members started harassing her. There are specific allegations that petitioner had illicit relations with some other girl. A panchayat was also held in which petitioner-accused had assured that he would not indulge in any such activity in future. However, one day before this occurrence a telephonic message was received by the complainant that she was being harassed by the petitioner and his father. She committed suicide leaving behind two minor children.
