This petition under Section 438 Cr.P.C. is for releasing the petitioner on anticipatory bail in case FIR No.72 dated 03.5.2012, under Sections 452,323,324,326,34 IPC, registered at Police Station Sadar, District Amritsar.

Learned State counsel on instructions from ASI Malook Singh submits that the petitioner is juvenile and has joined the investigation.

Taking into consideration the fact that the petitioner has been attributed simple injury and all other offences mentioned in the FIR being bailable except Section 452 IPC, the petitioner can be granted concession of pre-arrest bail.

Petition is allowed.

Interim order dated 21.11.2012 is hereby made absolute subject to the conditions under Sections 438(2) Cr.P.C. with an additional condition that the petitioner will not commit similar offence of which he has been booked, during pendency of the trial. In case of violation of any of the conditions, it will be open to the prosecution agency/complainant to approach this Court for cancellation of bail of the petitioner.
