Darshan Singh, the petitioner has sought pre-arrest bail in a case registered by way of FIR No. 17 dated 10.09.2012 at Police Station NRI Moga, District Moga, for an offence punishable under sections 465, 467, 468 and 471 IPC.

Learned counsel for the petitioner submits that the case against the petitioner is of forging of death certificate of Kewal Singh. According to him, Kewal Singh, brother of the petitioner is missing since 1983 and the death certificate is alleged to have been forged of this person. According to him, the

mutation sanctioned on the basis of that certificate has been sanctioned in favour of all his heirs and no undue benefit has been obtained by the petitioner in this transaction. He further submits that the petitioner has joined the investigation and has cooperated with the same.

Learned State counsel, on the instructions of Jagtar Singh,ASI, admits that the petitioner has joined the investigation. According to him, it is a case of forgery of death certificate of Kewal Singh.

It is a case where the complainant is Nirmal Singh. The mutation has been sanctioned in his favour also. Nirmal Singh did not see the petitioner forging the document. The document is already with the police and for this reason, custodial interrogation of the petitioner is not required. The petitioner has already joined the investigation. In these circumstances, I find the petitioner to be entitled to pre-arrest bail. Hence, the petition is allowed. The order dated 31.10.2012 granting interim anticipatory bail to the petitioner is made absolute.
