Petitioners No. 1 and 2 are the father-in-law and brotherin-law of the deceased. The marriage of deceased with Bara Singh was solemnized 10 years before the occurrence. Initially, the proceedings under Section 174 Cr.P.C. were conducted on the statement of father of the deceased that his daughter was suffering from typhoid for the past 4/5 months. In fact there were injuries on the dead body of deceased evidencing physical assault and harassment. Viscera was sent to the office of Chemical Examiner and chlorocompound group of insecticides was detected. The doctor also gave the opinion that death was due to poisoning. The statement of sister of the deceased has since been recorded during the trial, apart from examining the doctor, who conducted autopsy on the dead body. Now, an application has been filed before the trial Court for summoning additional accused, namely; the sub-inspector of Police who conducted proceedings under Section 174 Cr.P.C.

The petitioners are in custody from 27.10.2012. The husband of the deceased, however, is already in custody.

Though, the allegations in the FIR are quite serious but so far as the petitioners, who are father-in-law and brother-in-law of the deceased and are in custody for the past about 1 year, I deem it a fit case to order their release on bail on furnishing bail bonds to the satisfaction of the trial Court.
