Petitioner Nausad has filed this petition for grant of regular bail to him in case FIR No.1239 dated 29.11.2010 registered for the offences under Sections 399 and 402 IPC at Police Station, City Panipat.
Learned counsel for the petitioner has argued that the petitioner was on regular bail. On 26.7.2012, an application for exemption was filed by him, which was rejected by the Court and his bail was cancelled. The accused/petitioner surrendered in the Court on 29.8.2012 himself, which itself shows his conduct. The petitioner has been in custody since 29.8.2012, therefore, no useful purpose will be served by keeping him in custody till the decision of the case by the trial Court.
Keeping in view the facts and circumstances of the present

case, the criminal miscellaneous petition is allowed and the petitioner on his furnishing personal bond and surety to the satisfaction of the learned trial Court/Duty Magistrate shall be admitted to bail.
