Quashing of FIR No. 200 dated 24.10.2007 under Sections 353, 186, 332, 148, 149 IPC registered at Police Station Ghal Khurd, District Ferozepur (Annexure P1) on the basis of compromise dated 8.4.2013 (Annexure P-2).

he was travelling in a bus from Faridkot to Delhi he stopped the bus at Talwandi Bhai roundabout to drop the passengers. At that time, one golden color accent car bearing registration No. PB-10-AM-2994 which was being driven by Jagnam Inder Singh stopped after passing the roundabout. Jagnam Inder Singh and Jagdeep Singh @ Jaggi armed with Kirpan, Sunny Kumar @ Amit Kumar along with two more unidentified persons came out from the car and started using abusive language. Thereafter, Jagnam Inder Singh gave a kirpan blow on the right shoulder of the complainant and in the same manner Jagdeep Singh @ Jaggi hit on the back of the complainant and then conductor of Mohinder Khanna bus pelted a stone towards him which hit on the left side of forehead of the complainant. After raising an alarm all the persons ran away. In this background the FIR was registered. The complainant lost his gold chain of two tolas. The entire incident was witnessed by the driver Gurtej Singh.

During the pendency of the trial on the stage of evidence, the parties have entered into a compromise on 22.1.2013 (Annexure P2).

On notice, respondent No.2 has put in appearance and has been identified by his counsel. He has tendered his affidavit to the effect that with the intervention of the respectables the matter has been compromised and he has

Crl. Misc. No. M-14590 of 2013 [ 3 ] no objection if the FIR in the present case is quashed.

After going through the compromise deed (Annexure P2) and the affidavit, the Court is satisfied that the compromise arrived at between the parties is genuine and without any pressure or coercion.

Consequently, in view of the above circumstances and in view of the judgment of the Hon'ble Supreme Court in the case of Madan Mohan Abbot vs. State of Punjab 2008 (4) S.C.C. 582 and the law laid down by the Full Bench of this Court in the case of Kulwinder Singh and Ors. vs. State of Punjab and another 2007(3) RCR (Crl.) 1052, FIR No. 200 dated 24.10.2007 under Sections 353, 186, 332, 148, 149 IPC registered at Police Station Ghal Khurd, District Ferozepur (Annexure P1) is quashed with all consequential proceedings arising therefrom qua petitioners.
