During the course of preliminary hearing, the following order was passed, by a Co-ordinate Bench of this Court (Anmol Rattan Singh, J.) on April 18, 2013:-

“The petitioners are both of marriageable age as per educational certificates produced in Court today in originals. Photocopies of Voter Identity Card, issued by Election Commission of India, and matriculation certificate, issued by Punjab School Education Board, have also been annexed as Annexures P-1 and P-2 with this petition.

They have stated that they have married with each other of their own free will on 14.04.2013 at Hanuman Mandir, Focal Point, Ludhiana. Photographs of marriage ceremony have also been annexed as Annexures P-3. On account of this marriage, they are apprehending threat to their lives and liberty at the hands of respondents No.3 to 5, who are parents and aunt of petitioner No.1.

Notice of motion for 07.05.2013.

In the meanwhile, respondent No.2, i.e. The Senior Superintendent of Police, Hoshiarpur, is directed to ensure that the life and liberty of the petitioners are not put to risk and threat, at the hands of the private respondents or any other persons.”

After hearing the learned counsel for the parties, going through the record with their valuable help and without commenting/expressing any opinion on merits, in regard to the ages of the parties and the validity of their marriage or otherwise, the instant petition is partly accepted. Respondent No.2 is directed to protect the lives and liberty of the petitioners, in accordance with law. At the same time, respondent Nos. 3 to 5 are restrained from illegally interfering in their (petitioners) peaceful living/lives.
