It has been contended by learned counsel for the petitioneraccused that there is dispute regarding payment of consideration of the agreement executed between petitioner and complainant regarding Killa No.25/1, Khasra No.24 and that petitioner has already filed civil suit for getting the said agreement set aside in which civil court has already passed the order for maintaining status quo. It is further contended that the alleged lease deed, reference of which has been made in the FIR, pertains to some other Killa number. It is submitted that earlier in order dated 05.04.2013 of this Court, it was inadvertently typed as 'same Killa number' rather the same pertains to 'some other Killa number'. It is further contended that complainant, who is a property dealer, has cheated the petitioner and has obtained his signatures on agreement without paying any consideration and thereafter, 17,00,000/- were transferred in his account and that he is ready to return 17,00,000/- to him. It is further contended that pursuant to order dated 05.04.2013 passed by this Court, petitioner has already joined the investigation.
