Harmeet Singh – petitioner has filed this petition under Section 482 Cr.P.C. for quashing FIR No. 86 dated 12.7.2012, under Sections 420, 120-B IPC, registered at Police Station Sadar Ludhiana, District Ludhiana, on the basis of compromise.

The report of the trial Court was called for. The report has been received in which it is mentioned that parties have arrived at a compromise. An amount of 3,00,000/- has been paid to the complainant and an amount of 3,50,000/- is to be paid in the Court.

Learned State counsel has submitted that another accused namely, Chander has not been arrayed as a party.

Counsel for the petitioner has submitted that there is no person in the name of Chander.

Counsel for the complainant has stated at the Bar that he has no objection in case FIR is quashed against said Chander also.

Today demand draft No. 102919 dated 27.5.2013 for a sum of `3,50,000/- has been handed over by the counsel for the petitioner to the complainant, who is present in Court alongwith his counsel Sh. B.R. Rana, Advocate and has been identified by ASI Balbir Singh. Complainant has also stated at the bar that he has no objection in quashing of the FIR altogether even against Chander.

So, in these circumstances and view of compromise and in view of authority reported as Kulwinder Singh and others vs. State of Punjab and others 2007 (3) RCR (Criminal) 1052, the abovesaid FIR stands quashed against the petitioner, as well as, against Chander. Further proceedings, in pursuant to that FIR against the petitioner, as well as, against Chander, also stand quashed.
