Accused Pardeep has filed this petition for bail in case FIR No. 216 dated 28.5.2012 under sections 302,324,323,341,148/149 IPC and 25 of the Arms Act, Police Station Safidon, District Jind.
I have heard learned counsel for the parties and perused the
case file.
Counsel for the petitioner contended that the case of the petitioner is identical to his co-accused Dharambir who has been granted

bail by this Court vide order dated 15.2.2013, Annexure P/6.
Learned State counsel on instructions from ASI Mohinder Singh admitted this factual position and stated that petitioner had allegedly caused gandasi blow to Krishan on his back. However, MLR Annexure P/8 of Krishan does not depict any injury with sharp weapon. Krishan had only two abrasions and two bruises as per MLR Annexure P/8. Learned State counsel also stated that the petitioner is in custody since 4.6.2012 i.e. for almost one year.
In view of the aforesaid, without meaning to express any opinion on the merits, the instant bail petition is allowed. Bail to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Jind.
