CM No.19340-CII/2013 has been filed on behalf of the applicant/respondent-landlord for preponing the date of hearing fixed in the main revision petition and to dispose of the same by allowing the proposed amendment in the written statement sought by the petitioner/tenant.

At the joint oral request of the learned counsel for the parties, the present application is allowed and date of hearing fixed in the main revision petition is preponed and the main case is taken up for hearing today itself.

10.3.2011(P1) of the tenant/petitioner under Order 6 Rule 17 CPC for amendment of the written statement to the pending eviction petition filed by the respondent/landlord seeking eviction of the tenant from the demised premises i.e. half back portion on top floor of SCO No.375, Sector 32-D, Chandigarh, was dismissed.

At the time of hearing learned counsel for the respondent/ landlord, on instructions from his client, concedes to the prayer of the tenant and submits that he has no objection if the proposed amendment vide Annexure P1 is allowed.

In view of the aforesaid agreed stand of the landlord, present revision petition is allowed, impugned order dated 27.5.2011 (P3) is set aside and the proposed amendment vide P-1 is allowed and the learned Rent Controller, Chandigarh is directed to proceed further in accordance with law.
