Learned counsel for the petitioners, on instructions from Surender Mohan (Petitioner No.2 ), made a statement that he would not press the present revision petition on merits, in case some time is given to the petitioners for vacating the demised premises. He submits that the demised premises is in possession of the petitioners since 1965 and they would require some time to make the alternative arrangement. Petitioners have prayed for a period of six months to vacate the demised premises.
Keeping in view the fact that the petitioners are in possession as tenants since 1965 and would require some time to shift to another accommodation, I deem it appropriate to grant six months time to them subject to the conditions that (i) the petitioners shall pay the current rent of the period during which they remain in possession by virtue of order of this Court; (ii) the petitioners shall clear all the arrears of rent within 15 days from passing of this order, if already not paid against valid receipts;

(iii) the petitioners shall deliver vacant possession to the landlord on the expiry of six months period i.e. on or before 1.1.2014. It is made clear that the petitioners shall also file an undertaking by way of an affidavit in this regard before this Court within 15 days. It is also made clear that in case of any violation of the aforesaid arrangement which is being made on the asking of the petitioners, they would not only be liable for contempt of Court proceedings but the possession of the demised premises shall be taken by the landlord through the help of police, if need be, on the said date i.e. 1.1.2014.
Revision petition stands disposed of.
