There is no representation for the petitioner. I have examined the case and I find that the case would require to be disposed of on a short consideration that the case gives rise to.

The judgment debtor is in revision against the order passed on 09.04.2005 setting out various dates for sale of the property in execution of decree for recovery of money. The Court had settled dates between 28.04.2005 to 11.06.2005 for auction. I find absolutely no merit in a revision challenging such a direction. This Court, however, on issuing notice to the respondent on 27.05.2005 has directed ` 5,000/- to be paid on or before 30.05.2005 and has granted stay on proceedings. I do not think stay can be allowed to operate any further. The petitioner has obtained indulgence for sufficiently long time to defeat the execution process.

The civil revision is dismissed as wholly vexatious and without

any merit.
