(1). This petition under Section 560(6) of the Companies Act, 1956 seeks a direction to the Registrar of Companies, Punjab, Chandigarh and Himachal Pradesh for restoration of the petitioner’s name in the Register maintained by the Registrar of Companies.

The petitioner-company was incorporated and registered with the Registrar of Companies on 06.08.1983 vide registration No.5533 of 1983 but its name was struck off from the Register as is evident from the information displayed on the website (Annexure P3) of the Ministry of Corporate Affairs, Government of India.

(3). The Registrar of Companies has filed written statement today which is taken on record. It is averred that there is no objection against the restoration of petitioner’s name in the Register of Companies provided that it complies with the statutory requirements and files the pending balance sheets and annual returns along with requisite fee as required by law.

(4). Counsel for the petitioner undertakes that the petitionerCompany shall do the needful.

In this view of the matter, this petition is allowed and the name of the petitioner-company is ordered to be restored in the Register of Companies, subject, however, to its complying with the statutory formalities and filing the pending balance sheets and annual returns along with requisite fee as required by law.
