After considering the entire evidence, the learned trial Court recorded a finding that the death of Balkar Singh was wrongfully caused by the defendant on 25.07.1984. It also found that Balkar Singh was 32 years of age and by applying the multiplier of 16, assessed the net loss as Rs.1,60,000/-. The suit was decreed in respect of amount claimed i.e. Rs.1 lac, though the learned trial Court found that the plaintiffs are entitled to Rs.1,60,000/-. In defendant's appeal, the first Appellate Court maintained the findings recorded by the trial Court after taking into consideration the statement of defendant DW-1. The learned first Appellate Court returned a finding that Balkar Singh was earning Rs.25,000/- per annum from the agricultural avocation, whereas spending Rs.12,000/- on the land itself annually and spending Rs.3000/- on himself. The learned first Appellate Court assessed the income on the basis of minimum wages for an agricultural labourer as Rs.780/- per month. Thus, Rs.200/- per month was taken into consideration as his personal expenses and Rs.600/- per month as the monthly contribution to the wife and the family members.
