The appellant had filed a suit for declaration that nomination of the defendant/respondent entered in the saving Bank Account No.503436 in the name of Smt. Mahadevi was null and void and on the basis of that nomination, he can not withdraw any amount from the aforesaid account and the appellant was entitled to withdraw the aforesaid amount. The suit was decreed, holding the plaintiff/appellant is entitled to the amount of saving Bank Account No.503436 standing in the name of Mahadevi. In the appeal filed by the defendant/respondent, the lower Appellate Court set aside the judgment of the trial Court and dismissed the suit.
The present second appeal was admitted on 21.03.1985. However, no interim order in favour of appellant was passed. Learned counsel for the parties are agreed on the fact that the respondent had already withdrawn the

amount lying in the saving Bank Account No.503436 in the year 1984 itself. Learned counsel for the appellant does not dispute this fact and makes a statement that in view of such circumstances, he does not wish to press the second appeal.
